Instead of filing a custody action, one may choose to terminate the parental rights of one or both of the child’s biological parents. The main reason one chooses to terminate a parent’s parental rights is for the purpose of ultimately adopting the minor child/children. One can terminate a parent’s parental rights if certain grounds are met pursuant to North Carolina General Statute 7B-1111 and if such a termination is in the best interest of the minor child/children. Said process requires a hearing before a district court judge. Adoptions are determined by the Clerk of Court and do not typically require a formal hearing.
